Terms of Service

Important: These Terms govern purchases and use of HiveForge packages. By purchasing, downloading, accessing, or using a package, you agree to these Terms.

1. Company and Contact

These Terms are between you and HiveForge Systems LLC, PO Box 10, South Park, PA 15129. Contact: RogerDeLosh@HiveForgeSystems.onmicrosoft.com.

2. HiveForge Products

HiveForge provides digital packages, documents, folder structures, memory maps, prompts, instructions, setup paths, and related support materials intended to help customers organize information for use with AI tools. Product contents and support scope are described on the applicable sales page or checkout page.

3. One-Time Purchase; Third-Party Costs

Unless a sales page expressly says otherwise, HiveForge package prices are one-time charges and are not HiveForge subscriptions. Third-party products or services—such as AI subscriptions, cloud storage, internet access, hardware, hosting, Microsoft services, or local AI tools—may have separate costs and terms that are not included in the package price.

4. Payment and Checkout

Payments are processed through Stripe or another identified payment provider. You agree to provide accurate billing information and authorize the stated charge. Taxes may be collected where required. Your use of the payment provider is also governed by that provider's terms.

5. Delivery and Setup

Digital products may be delivered by download, email, customer portal, or another method shown at checkout. You are responsible for using a compatible device, retaining your download, following the included setup path, and maintaining backups of your files.

6. License and Ownership

After full payment, HiveForge grants you a limited, non-exclusive, non-transferable license to use the purchased package for your own personal or internal business purposes. HiveForge and its licensors retain ownership of the package design, templates, documentation, branding, and other intellectual property. You may customize your working copy for your own use, but you may not resell, sublicense, publish, distribute, or offer the package or substantially similar copies as a competing product without written permission.

7. Your Files, Accounts, and Security

You remain responsible for your files, backups, passwords, AI accounts, storage accounts, access permissions, device security, and decisions about what information you connect to an AI service. Do not place confidential, regulated, or sensitive information into an AI tool unless you understand and accept that tool's terms, privacy practices, and security controls.

8. AI and Third-Party Services

HiveForge is independent from third-party AI providers, storage providers, software vendors, and Stripe. References to compatibility mean the package is designed to support a workflow with applicable tools; they do not guarantee that every provider, model, feature, account level, operating system, or future product change will work identically. Third-party services may change, restrict, discontinue, or charge for features at any time.

9. Acceptable Use

You may not use HiveForge materials to violate law, infringe rights, distribute malware, gain unauthorized access, misrepresent the product's origin, or create a competing resale package based substantially on HiveForge materials.

10. Support and Custom Work

Included support, if any, is limited to what is stated on the sales or checkout page. Custom setup, migration, integration, automation, consulting, or troubleshooting outside the included scope may require a separate written agreement and fee.

11. Refunds and Order Issues

Refund eligibility and any cancellation terms will be shown at checkout or communicated with the order. Contact RogerDeLosh@HiveForgeSystems.onmicrosoft.com promptly if a file is inaccessible, duplicated, corrupted, or materially different from the purchased description. Nothing in these Terms limits rights that cannot legally be waived.

12. Disclaimers

HiveForge packages are organizational and workflow tools. They are not legal, financial, medical, aviation-safety, cybersecurity, or other licensed professional advice. Except where prohibited by law, products are provided "as is" and "as available" without warranties of uninterrupted operation, error-free results, fitness for a particular purpose, or guaranteed AI output.

13. Limitation of Liability

To the fullest extent permitted by law, HiveForge will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of data, profits, revenue, opportunity, or business interruption; or actions taken based on AI output. To the fullest extent permitted by law, HiveForge's total liability arising from a particular purchase will not exceed the amount you paid HiveForge for that purchase.

14. Governing Law and Disputes

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law rules. Before filing a formal claim, each party agrees to make a good-faith effort to resolve the issue by written notice and direct discussion. Any dispute that proceeds in court will be brought in a court with lawful jurisdiction over HiveForge Systems LLC, unless applicable consumer law requires otherwise.

15. Changes and Severability

We may update these Terms for future purchases or use. If any provision is found unenforceable, the remaining provisions will continue in effect. Failure to enforce a provision is not a waiver.
